Welcome to Pantom. These Terms of Service ("Terms") govern your access to and use of the Pantom software platform, website (pantom.co.uk), applications, and related services (collectively, the "Services"). By registering for an account or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.

1. Account Registration and Security To access the Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your password and for all activities that occur under your account. You must immediately notify Pantom of any unauthorized use of your account.

2. Subscription, Billing, and Payments

Fees: Access to the Services requires payment of subscription fees (e.g., the £1/month Free Plan or premium tiers) as presented during checkout. All payments are processed securely via third-party payment processors (e.g., Stripe).

Telecom Usage Costs: Certain features, such as SMS messaging and voice calls, incur variable usage fees (e.g., 5p per text). By using these features, you authorize us to bill your payment method on file for these telecom infrastructure costs.

Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled prior to the renewal date.

Cancellations and Refunds: You may cancel your subscription at any time through your account dashboard. Payments are non-refundable, and we do not provide refunds or credits for partially used billing periods.

3. SMS Communications and Compliance (Mandatory) By providing your phone number and opting in, you agree to receive text messages from Pantom regarding your account, system notifications, and customer support. Message frequency varies. Message and data rates may apply.

How to Opt-Out: You can cancel the SMS service at any time. Simply text "STOP" to the shortcode or number from which you received the message. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

Customer Care: If you experience issues with the messaging program, reply with the keyword "HELP" for more assistance, or reach out directly to [email protected].

Acceptable Use: You agree not to use Pantom's messaging tools to send unsolicited spam, illegal content, or any communications that violate the UK Privacy and Electronic Communications Regulations (PECR) or applicable telecommunications laws.

4. Acceptable Use Policy You agree not to misuse the Services. This includes, but is not limited to:

Attempting to hack, disrupt, or compromise the integrity of our systems.

Using the platform to distribute malware, phishing links, or malicious code.

Impersonating another business or individual.

Reselling or sublicensing the platform without explicit written permission.

5. Intellectual Property Pantom retains all right, title, and interest in and to the Services, including all software, design, text, graphics, and intellectual property rights. Your subscription grants you a limited, non-exclusive, non-transferable license to use the platform for your internal business operations.

6. Limitation of Liability and Disclaimer of Warranties The Services are provided on an "AS IS" and "AS AVAILABLE" basis. Pantom makes no warranties, expressed or implied, regarding the uptime, reliability, or fitness for a particular purpose of the software. To the maximum extent permitted by UK law, Pantom shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business goodwill arising from your use of the Services.

7. Termination We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

8. Governing Law These Terms shall be governed by and construed in accordance with the laws of [Insert Jurisdiction, e.g., Scotland / England and Wales], without regard to its conflict of law principles.

9. Electronic Communications, SMS, and Conversational Consent By providing your email address and mobile phone number to Pantom Software Ltd, you explicitly consent to receive transactional, operational, and promotional communications from us. This includes system alerts, onboarding support, and marketing updates.

10. Conversational Consent: If you initiate a text message conversation with our business numbers, or if you reply to any of our outbound text messages (other than requesting to opt-out), you are providing express implied consent to continue receiving SMS communications regarding that inquiry or related services.

11. Opting Out: You reserve the right to withdraw this consent at any time. To stop receiving SMS messages, simply reply with the word STOP, CANCEL, or UNSUBSCRIBE. To stop receiving emails, click the "Unsubscribe" link found at the bottom of any automated email. Please note that standard message and data rates may apply depending on your UK mobile network provider.
